Terms of Use

These Terms of Use govern your use of fsg.supply, FSG OS at os.fsg.supply, and the secure order and portal links Fortress Supply Group ("FSG", "we", "us") sends (together, the "Services"). By using the Services you agree to these terms. If you use them on behalf of a company, you confirm you are authorized to accept these terms for it.

What FSG is, and what these terms do not cover

FSG is a materials supply and logistics company. We are not a bank or a lender, and nothing on the Services is an offer of credit or financing.

The supply of materials, pricing, payment terms and any credit are governed by the written agreements you sign with us, such as a Purchase Agreement or credit agreement. If those agreements conflict with these terms, the signed agreements control.

FSG is independent of Ygrene. Participation in the Ygrene program, and the approval of any project or financing, is decided by Ygrene under its own terms. We do not guarantee any approval.

FSG OS accounts

  • FSG OS is available only to people we invite. Accounts are personal and may not be shared.
  • Keep your password and sign-in codes confidential, and set up multi factor authentication when we ask you to.
  • You are responsible for activity under your account. Tell us at info@fsg.supply right away if you suspect unauthorized use.
  • Use only the information and features your role gives you access to, and only for FSG business.
  • We may suspend or end access at any time, including to protect the security of the Services.

Secure order and portal links

Order and portal links we send are issued to you for your company's use. Treat them as confidential, do not forward them outside your company, and tell us if one reaches the wrong person. Links may expire or be revoked.

Information and documents you provide

  • Provide information that is accurate and complete, and keep it up to date.
  • Upload only documents you have the right to share.
  • You keep ownership of what you provide. You allow FSG and our service providers to use it to deliver the Services and as described in our Privacy Policy.

Acceptable use

You agree not to:

  • Use the Services for anything unlawful, fraudulent or misleading.
  • Access or try to access information, accounts or systems you are not authorized to use.
  • Probe, scan or test the security of the Services, except as permitted by our published security policy at os.fsg.supply/security.
  • Upload malicious code, or interfere with or overload the Services.
  • Copy, scrape or harvest data from the Services by automated means.

Our content

The Services, including their design, text, graphics, logos and software, belong to FSG or its licensors. You may use them only to do business with FSG.

Third party services

The Services link to or use services run by others, such as DocuSign, WhatsApp and Ygrene. Those services are governed by their own terms, and we are not responsible for them.

Disclaimers

The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non infringement. We do not promise the Services will be uninterrupted or error free. Information on fsg.supply is general and may change without notice.

Limitation of liability

To the fullest extent permitted by law, FSG will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim arising from the Services is limited to one hundred U.S. dollars. This section does not limit any obligation under a written agreement you have signed with us.

Indemnity

You agree to indemnify FSG against claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Services or your breach of these terms.

Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute arising from the Services will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

Changes and contact

We may update these terms. The effective date at the top shows when they last changed, and continued use after a change means you accept it.
